Art 370: HC Judgment In a landmark Judgment, the J&K High Court has observed that Art.370 is a ‘permanent’ provision of the constitution & that it cannot be “abrogated, repealed or amended”. It has also refused to repeal Art. 35A which gives protection to existing laws.Views:• Art.370 cannot be repealed or amended because it shows a conceptual framework of relationship between the Union of India & the state of J&K.• Art 35A is also a part of the basic structure of the Constitution which gives protection to the existing laws & special rights and privileges to the residents of J& K and therefore cannot be repealed or amended. < < Back
